Abstract

The precautionary measure of pretrial detention has been applied indiscriminately in Ecuador in recent years, the courts omitted the inter-American standards under which deprivation of liberty must be carried out exceptionally and under the requirements of articles 7.1, 7.2 and 7.3 of the American Convention on Human Rights. In the present investigation I will address the jurisprudential development of preventive detention in relation to the principle of innocence and the repercussions of the interAmerican system in the national legal system, in addition to the implications of this legal figure in judicial decisions and in the Ecuadorian political scene.
