Abstract

This research analyzes the lack of determination of a criminal offense for behaviors that directly violate sexual integrity, whose means of execution is the use of Artificial Intelligence in the case of deepfakes. This normative vacuum highlights the inexistence of a behavior that is criminally sanctioned, and, in addition, two terms are mentioned that have not been regulated in any sense within the national legislation, that is, first, Artificial Intelligence, a new technological tool that allows performing several actions and obtaining results based on an algorithm and second, deepfakes, which are those false contents that create disinformation. Based on the investigation of cybercrimes and crimes against sexual integrity, it is proposed a reform to the Organic Integral Penal Code that respects the principle of legality and sexual integrity mainly.
